PHOENIX (3TV / CBS 5) – Phoenix Police released a surveillance video of an incident involving two shoplifters who escaped from an Ace hardware device after a bystander shot them but missed and hit a shop manager. It happened at around 9:00 am on January 30th at Howards Ace Hardware near Indian School Road and 32nd Street. A surveillance video shows two men reversing into a parking lot in front of the store and then entering separately. You are in the store a little over 10 minutes. From the cameras inside, you can see the men walking out side by side, carrying buckets full of items. They look at each other and then take a break. At that point, the staff learned what was happening and tried to stop it. The video shows a manager in a white shirt walking outside the store. The two shoplifters are running towards their car and one is trying to get through the passenger door when a woman off-screen shoots them. The bullet hits the manager in the leg. “Even though she’s trying to arrest a citizen or be a good person and help out here, under our law you still had to use reasonable judgment, you can’t just fire a gun,” said attorney Benjamin Taylor, who is not affiliated with this Case. Nya Reyes, 46, was charged with aggravated assault and firing a gun within the city limits. “The best scenario would have been to just call the police and let the police take care of it because they were so far from the scene that they really have no right to arrest a citizen for being so far,” explained Taylor. “Because you fled, under our law, she can’t just take out a gun and shoot someone because you have a chance to shoot other innocent people.” Howards Ace owner says the manager has still not been able to get back to work. He says the bullet smashed his knee and that he is now going to physiotherapy so that he can hopefully be able to walk again one day. When Reyes was arrested, the shoplifters were still at large.
